Legal Question in Family Law in Arkansas

Parental Custody

How old does a child have to be to decide which of his divorced parents he would like to live with? Does it matter if a judge ruled one parent over the other in the divorce and custody settlement on the basis of keeping the child in the same family household because of school, friends, sports ect.?

Re: Parental Custody

I disagree with Basil. It depends on the judge. Some will listen to the wishes of a child at 12, some at 15 and some at 18 (read never). Even if, it is not a slam dunk by any means

the standard to change is a significant changed circumstance such that it is in the best interests of the child to change custody. That is a tough nut to crack in any court.

12, (which child do you love more is a similar question to ask an adult...) All things may be considered and affect the procedure and substance.
