Legal Question in Family Law in Arkansas

Past due child support

I was divorced in October 1998 in Arkansas, awarded custody of my 3 minor sons and awarded $85.00 a WEEK in child support (not $85.00 per child). To date, I have rec'd approx. $3000. I remarried in June 1999, my oldest son turned 18 in June 2000 and my two younger sons were adopted in Oct. 2004. Am I still entitled to the child support in arrears up to time of adoption? If so, would I pursue recovery in Arkansas? In Texas where NCP lives or in Virginia where I live?

Re: Past due child support

If you could afford to retain counsel in Texas to pursue this alleged "dead beat dad", that would be the preferred approach. However, if the C notes are currently not that abundant in your pocket book for this type of expenditure, you could contact your local district office of Virginia's Division of Child Support Enforcement(DCSE) and make application for their services to make a referral to their counterparts in Texas for the collection of your arrearages.

And, yes, you are presumably entitled to all arrearages accrued up to the time at which the obligor's child support obligations ceased by virtue of the children's adoption or otherwise.
