Legal Question in Family Law in Arkansas

Residence of the home

My boyfriend recently got divorced. He was awarded primary residence of the home and is paying all the mortgage payments and utilities. I have moved in with him and the ex-wife is threatening to get a court order to have me kicked out. Is that legally possible since he the divorce decree stated this is his primary residence and he is responsible for all the bills pertaining to the house?

Re: Residence of the home

Does your boyfriend have children of that marriage living within the home?

If so, then that may be reason she can ask the Court to keep you out of the house while the children are there. There is usually a condition on custody and/or visitation of no overnight guests of opposite sex when children are present.

If there are no children, then it is doesn't seem she can do anything about it.

Good luck.
