What are my rights?

My son was 3 yrs. old when my ex and I got a divorce. In my divorce decree, I have full custody of my son with no restriction on visitation from his father. When my son was 5 1/2 yrs. old, due to financial difficulties, I sent him to live with his father, with the agreement that he would only stay for 1 yr. or until I became financially stable. I have visitation with my son every weekend and holidays. He currently attends kindergarten in the town where he, his father, and new step-mother live. I plan to rusume custody of him when he finishes kindergarten and he will live with me permanantly (with unrestricted visitation to his father); however, I am concerned that his father will try to fight me for custody. What are my rights? How should I approach the situation of getting my son back? Any advice would be greatly appreciated.

This is a difficult situation. I would send a letter to your "ex" reminding him of your agreement with him that your son was to stay for only a year. Be polite or he'll file a motion to change custody.
