termination of parental rights
I have two children from my first husband, ages 5 & 6. We divorced in 2002 in Texas. I am now remarried and living in Arkansas. The biological father has not paid child support in over a year and hardly ever sees the children. He has no home of his own, living instead in a one bedroom home with a friend. He drinks heavily and claims to do drugs, although I have no proof. He neglects the children on the few occasions that they go to see him. He has also never paid medical bills or insurance as the divorce decree requires. We have thousands of dollars worth of medical bills for our oldest child. The biological father never calls or comes to see the children unless we contact him. In the end, all this does is disrupt the children and upset them. We have stopped trying to call him at all now. My current husband is the only true father my children have known. For many more reasons than I can list here, the biological father is an unfit father. What are our options? Could we have his rights terminated so that my husband can adopt the children? What type of proof would be required to do so? My husband and I feel that we have gone above and beyond what is required by trying to force him to have contact with the kids and we are sick of it.
