Unmarried Dad's Rights in Seeking Joint Custody
My son's 19 month old daugther has lived with him for the past year, along with him paying health insurance and child care expenses. The mom has been virtually absent from the child's life. My son is listed on the birth certificate, establishing paternity, but there is no formal custody arrangement. Last week the mom came and took the child. My son would like joint custody of the child. The mom stated that she intended to move out of state with the child. What is my son's legal recourse?

He should file a petition to establish paternity and along with that petition an Order to Show Cause, with a temporary order requesting that custody be returned to him. He must move quickly in this matter with the passing of each day his position becomes weaker. Retaining an attorney with experience in this area would be advisable.
