my exhusband and i are going through a divorce, he is not fighting me on custody of the children and we have agreed to him having visitation everyother weekend. The divorce has been filed but we have not gone to court yet. My dilemma is that he only has the children four days a month and chooses to sign up for overtime on the weekends that he has them leaving them with his parents. however he threatens to take custody if I go out on a date anytime i have the boys which is the other 26 days of the month. Can he do this and is there anyway to make him stop working VOLUNTARY overtime when he has the children for the weekend? Also his family has a habit of snapping at the children because they do not like me, what can i do about that. It is not fair to the children to take their animosity towards me out on them.

He cannot keep you from dating someone else. He will not be able to obtain custody over that. However, you can expect that the court will not allow "overnight visitors of the opposite sex" while the children are in the home. So keep that in mind.
There is no way to keep him from working overtime.
