civil judgements

there is a civil judgement on my credit report that I wasn't aware of until we began the process to purchase a new home. It was filed in Texas 5 years ago. I now live in Ark can this judgement be used in Ark and if so how? What are the limits time wise can it be removed?

It depends on why you weren't aware. It definitely depends

on state law, but there's a very general rule that if you

never received notice, you can ask a judge to vacate the default

judgment, and you should win that almost as a matter of right.

However, the plaintiff can then make his case (e.g., at a trial)

and win the judgment again if it was indeed money you owed.

How much is it for? Unless it's a lot of money, the bank

probably won't care, and even if it IS a lot, they might still

not care about the debt very much, especially if you have a

healthy down payment. However, they might care a bit that you

look like someone who tries to run away from his debts.
