Legal Question in Civil Litigation in Arkansas
Contract Dispute with Wireless Company
This question is for my father who isn't fluent in english. We were contacted by a collection agency representing a wireless phone company about a ~$1000 bill for a breach of contract at the beginning of this year. The only service we had with the company was for 1 year service 5 years ago (98-99). We cancelled our service with them at that time and have not heard anything from them since.
Now the collection agency is threatening to take us to court. Both the company and the agency refuses to provide us with a copy of the contract. My research shows the company has had numerous other similiar complaints about high fees for supposed breaches of contract and of extending contracts without consumer knowledge. I was unable to see some of the bills the company sent us because I've been away. And it appears alot of the information the company has was from very long ago.
What should I do?

Re: Contract Dispute with Wireless Company
You are going to need a copy of the contract. They would also need one to file anything with the court. If they do not actually have a debt that you owe, they may just be trying to get you to pay the debt. I don't know that, but it is always a possibility.
You need to contact them and let them know you aren't paying anything until you see a contract, current bill, and any other documentation for proving what your father owes.
