medical records transfer request by exiting physician
I operate a skin care clinic in Little Rock. We hired a physician part-time to perform our Botox procedure. There is no written contract and we paid he as outside labor (no taxes taken out, etc.). This physician was also working in another clinic performing the same procedures. We have now relieved him of his duties. He has come to me and told me that he wants the files on all the patients he has treated so that he can contact them and let them know that he is performing the Botox procedure at the other clinic. I have replaced him and am still doing these procedures at my office. Am I legally obligated to provide this info to him since he is in direct competition with us? Can I contact the patients and ask them is they want their records to remain with us?

I would be glad to answer this for you, but I need some more information. You may not be able to release the records. Please contact me or some other lawyer before you release those records.
