When to get married
hi, I am a US citizen wanting to marry a man who has over stayed his visitors visa. At this time he would also like to return to Mexico to visit his two children. I would like to know if it is best for him to return to mexico and then try to return legaly, or if marrying now will aid in his speedy return. Which is the best route to go - workers visa, fiance visa, is there a marriage pettion.

Marriage now followed by an adjustment of status should provide him advance parole (travel permit) to visit his children approximately 3 months after filing.
