Our vehicle was hit and totaled by a woman who ran a red ight. Her insurance company has put a low value on our new 2002 car. They have advised us that either we take what they offer or nothing. What are our rights?

You have the right to be paid the difference between the value of your car before the accident and its value now. If it is totaled, that means it has no value now. You need to demonstrate to the adjuster that you know what the blue book value of the car was at the time of the accident. There are a number of sites on the Internet which will give you a blue book value based on the model, make, year, and miles on the car.

If all else fails let the adjuster know you can take them to court if she does not deal fairly with you. Your biggest advantage is holding out to get the value you deserve. The adjuster wants to resolve the claim. Most adjusters are evaluated on the length of time it takes them to clear claims. The adjuster wants to move your claim as quickly off her docket as she can. Don't give up easily, but make sure you have a solid basis for your claim.
