Denied benefits

I was hospitalized in an out-of-network facility due to a need for emergency surgery. I was sent to this facility because there was no intensive care bed at the in-network facilities in the area. My condition was so unstable that the doctors decided that it would be safer to wait until they could build my blood count back up before doing the surgery. My insurance company wanted to have me transferred to another facility during this time which was medically unsafe. Now the insurance is declining payment saying it was not an imergency in teh first place. Do I need to talk to a lawyer?

If your doctor states medically it was an emergency and that it was medically necessary not to move you, in writing, and you send it to the insurer (keeping copies), your bills should be paid. Have the hospital where you were handle this - they have "social workers" who deal with insurers who won't pay for services. Speak to them since it is their bill being refused.
