insurance rep's computer crashed

I transferred two supplemental policies and signed up for a new accident policy at my job. All information on the new policy was done via computer including my authorizing signature. The following day I had an accident and when I left the hospital and called the representative for claim forms, she informed me that her computer had crashed an hour or so after she left me so I was not covered. She had ample opportunity the day it crashed to notify me. Is this not a case of professional negligence? I get no answers to my inquires to the company.

You say that her computer crashed after she left you. Does that mean she helped you fill out the forms? The question is when the policy was to go into effect. If it had been entered, as you thought, when you put it in the computer, you should be covered for your accident. If it wasn't in effect yet, was it their fault? You entered it in the computer and added your signature. What happened then? You may need to contact a lawyer and have him write a letter or make a call to the company to see what happened and get you some answers. It may be a simple matter to straighten out, but you do need to act soon.
