Legal Question in Insurance Law in Arkansas
Lapse in coverage?
I live in Arkansas, and we were recently hit with a tornado. However, I have two questions for this one situation. My mom had substantial damage done to her house by the neighbor's tree. We were told that they were not liable because it was an act of nature. How true is that?
The storm hit May 10th, prior to that my mom received a letter from her insurance company dated April 7th, stating that as of May 23rd, her insurance would cancel at 12:01 am. Her new insurance picks up May 23rd, but the original insurance company is now saying that she was not covered. She has the letter stating that her insurance wouldn't cancel until May 23rd. What are her legal rights? Was she covered?

Re: Lapse in coverage?
You should obtain the services of an attorney to evaluate your claim. From what facts you provided, it looks like you would have a viable lawsuit against the insurnace company for coverage. However, each case is fact specific and an attorney would need to see all of the documents in order to provide a qualified legal opinion.
