Legal Question in Insurance Law in Arkansas
Struck from behind
My son was stopped at a stop sign, started to pull into street. A pickup truck going the same direction struck him from behind. The other driver was found to be at fault but no ticket was issued. My son is 17 his car was a 1991 Ford Probe that had just been painted. THe other insurance wants to give us 2,000 for the car The blue book rates the max value at $2,000. We have over $5,000 in new parts, custom paint ect. The car received over $9,000 in damage. My son is complaining his next, wrist, back and ribs are sore but has not yet went to the doctor, however we have an appointment on Wed. My question is how can I push to get 1. The car reapaired or 2. Recover as much as possiable to replace it. We really put a lot of time, effort and money into making this a nice safe vehical. 3. Is their any potential for my son's pain and suffering and if so, can you extimate a ball park figure? and Lastly how do I push the adjuster to make this right. Not looking to get rich, just want a fair price for the damage.

You are always able to negotiate with an insurance adjuster. I hope you have receipts to show how much work was put into the car. There are other issues that you didn't cover in your letter that would determine how much insurance will pay you and how to best approach insurance. As far as the injuries, you do need to get your son to a dr. to document the injuries. You should inform the insurance company that your son was injured and may need medical treatment. You may want to contact an attorney to discuss this in more detail. There are a lot of lawyers that will offer a free initial consultation. Then they can steer you in the right direction to proceed from here.
