Legal Question in Insurance Law in Arkansas
veterans disability legislation
I am a 100% disabled veteran that my employer's disability insurance is off-setting both my social security and my veteran's disability - leaving me with the minimum amount of $100.00 which does not even cover my premium for insurance. Is there some legislation in Arkansas that protects my veteran's benefits from being used in this manner. I worked for this company for 20 years and paid my premiums with the anticipation that if needed, I would have the coverage. I understand the offset of the social security, but feel that my veterans beneftis should be excluded. My whole disability is from agent orange exposure in Vietnam and I feel that I have earned every cent that is due me. Please help me find some loop hole that will make this insurance company pay what is due me!

Re: veterans disability legislation
Your disability insurance is governed by the Federal law known as ERISA. You are the third veteran that I have heard of in the last month with this probelm. The insrurance carriers must have went to a seminar and decided to do this. I would need to know the name of the disability carrier so I can look at its policy language.
