Discremination

I was called into the office on 12-16-02 at the end of the work day to be told I was laid off due to cut back and no money. I was training to do someone else's job at the time and contiuing to do my own. The next day they brought a younger girl in that took my place at a higher pay who had previously quit 3 times.I beleive I have a case to sue them and want to know if I am correct or what I have to do. They lied to me and replaced me which was not cutting back at all. Now I have no job.

If you are over 40 you may have an excellent case for age discrimination based on the facts you cite. The value of your case will depend on such factors as:

1. How long you worked for the company;

2. Your discipinary record;

3. How much you made;

4. Whether you can find subsitute employment quickly;

5. How much younger than you is your replacement;

6. How much less money she is making;

7. How much less qualified for the job she is;

8. How the termination was handled; and,

9. Other factors.
