Legal Question in Employment Law in Arkansas
employer matched 401k, layoff, not fully vested
I have been employeed 2 years with a company. Been putting in 6%, company matched half. Do I have any rights to the half after layoff or must I try to negotiate for it in severance pay.

Re: employer matched 401k, layoff, not fully vested
Since you are not fully vested, you likely do not have a right to the full amount of your pension. However, any entitlement you may have is governed by the terms of the benefit plan. You need to get a copy of the plan and/or summary plan description and take a look at it. This is something that you may want to take to an attorney to look at once you have the plan documents.
