Legal Question in Employment Law in Arkansas

Forced on call without pay

I work in a non union plant in Arkansas as a technician.

There are days when an individual is designated as "partner relief" and must stay over an additional 4 hours if someone on your line calls in sick. During this designated period, the company states that we must make ourselves available for early call during our off hours and asks for you to sign a form if you don't answer your phone. We are not being paid to be on call and some of us have businesses outside of this job.

Can the company require us to be on call without pay and if not, what are the Arkansas labor statute(s) that apply for this issue.

Thank you,

Re: Forced on call without pay

Our law firm practices employment law, however,

we are not licensed in Arkansas. Our offices

are in Boca Raton and Fort Lauderdale, Florida.

My recommendation would be to contact an Arkansas

attorney. They will likely request additional

details of your job, such as job responsibilities,

hourly vs salary compensation, type of business /

service your company performs, etc.

Good luck to you!
