Legal Question in Employment Law in Arkansas

Moving Costs

I signed a piece of paper saying that I would pay back all moving costs if I left voluntarily or involuntarily before a year was up. The paper also said that I would get a review in 6 months that I never received. I found another job and I literally leave this job with only 2 weeks left on my full year. Since they didn't hold up their end of the bargain on the review, do I really have to pay back the moving costs?

The amount is $14,000. Thanks in advance for your time.

Re: Moving Costs

Those types of agreements are very common and are routinely enforced. In your situation it will depend heavily on the facts of the situation. Whether or not the promised evaluation is a material term of the contract in the court's view. If the judge finds that it is a material term of the contract, then chances are that the "payback" provisions will not be enforced. I caution you not to rely on this (no evaluation) as a basis to quit early if you cannot afford to pay back the $14K. You should see an attorney to review your agreement and give you specific advice concerning your specific situation, every case is different. The exact wording of the contract will be very very important to your case.
