salary based on hourly wages

Our employer bases our salary on a per hour rate. He calculates our pay based on the average yearly hours worked. We are paid twice a month. There are 4 full time employees and 1 part time employee. If we miss any hours during the day, our paycheck is docked for those hours. However, if we work overtime, we are not paid with the explanation that we are salaried employees. Is this legal? What are our rights?
