Legal Question in Employment Law in Arkansas

Salery to hourly wage Lost comptime

I went from salery to hourly with the lost of all my comptime of 166 hours for the year the company will not pay for any of the hours I put in extra. For the month of December was 77 hours because of the type of job I have. I was alway told to make myself availble to all volunteers...That means nights and weekends and then just take time off when i could. Now I have lost any time off with pay. What can I do?

See a lawyer about your exempt FLSA status

Go see a lawyer. The fact that you were on salary doesn;t necessarily mean you were an exemptemployee under the Fair Labor Standards Act.If you were not, then they owe you time and ahalf for all overtime hours worked. Privateemployers (on-government) cannot give comptime in lieu of overtime. Also if you qualifyand have a wage claim, they have to pay a 100% penalty and your lawyers fees.
