Property left by tenant after voluntary termination

I have a tenant who has not paid me for February's rent and moved out without notifying me of termination on Feb 10. At the start of the rental agreement, the tenant paid a total of $780 ($390 security deposit and $390 1st month's rent). The tenant moved his belongings on the 10th. Later that evening I discovered 2 large items left by the tenant and he has not attempted to get them. I recently moved the property from the dwelling. I expect the tenant to pay me for 10 days of prorated rent for February, plus labor from moving their belongings before I will relinquish his items to him. Do I have this right? I'm not sure that I understand the Landlord-Tenant Rignts fully. I also incurred a back injury while moving the items, could he be responsible for any medical expenses?

You do not have the right to keep his property, even if he owes you money. You will have to pursue the money he owes you in other manners. Keeping his property could be theft.

It is possible he is responsible for your injury, but probably difficult to get money. It would be difficult to prove this was the sole cause of your back injury. You should contact an attorney in your area if you want to look into this.
