Legal Question in Medical Malpractice in Arkansas

liver biopsy

A family member received a liver biopsy. During this procedure(needle -ct guided), the dr. pierced an artery. As a result, blood began to develop and capsule in the liver cavity. The family was told the body would absorb the blood and the patient would be fine. The hematoma ruptured, the patient went into surgery to repair the lacerated artery, but the patient died. Does this family have a legal case against the dr. who performed the liver biopsy? What is the statue of limitations in the state of Arkansas?

Re: liver biopsy

Yes, it is possible that this could be a malpractice case. We can't tell for sure until there has been some investigation. It sounds like a case I am involved with now where a biopsy needle lacerated an artery in another part of the body and the patient died.

I do not know off the top of my head what the statute of limitations is in Arkansas for malpractice.
