Legal Question in Military Law in Arkansas

Reenlistment

Our son has been discharged with other than honorable from the Marines. Fortunately he realizes what a grave mistake he has made and is trying desparately to find out if he can somehow get back in or reenlist in another branch.

Re: Reenlistment

He might be able to; it depends in part on the circumstances in which he was discharged.

Re: Reenlistment

I disagree slightly with Mr. Eisenberg's response - if your son got an Under Other Than Honorable Conditions [UOTHC] discharge, he almost certainly got a "Re-Enlistment" code that will bar him from reenlisting anywhere. Check the bottom of his DD Form 214, for the "RE" code - it's probably RE-4.

Now, that's not to say that it's totally impossible, but his only realistic shot is getting the USMC to "upgrade" his discharge and to change his Reenlistment Code. If drugs were involved, that's going to complicate things even more. If not, then the nature of the misconduct that led to the UOTHC has to be dealt with. But, without looking at his discharge paperwork [which hopefully he didn't throw away], no one can really give you a definitive answer. If he doesn't have that, he's got to write and get copies. And lastly, "generally," this needs to be done within two (2) years of his being discharged.

Good luck and feel free to email me if you have any other specific questions.
