Legal Question in Personal Injury in Arkansas

Automobile Accident

Hi, I was wondering how do the insurance companies determine the amount that a person is to receive for pain and suffering? Is there a formula that they go by? Thanks and have a wonderful day!

Re: Automobile Accident

Valuation of a personal injury is very subjective

and therefore methods of doing this vary greatly

from jurisdiction to jurisdiction and judge to

judge. First you need to know what type of injury

is involved. If it is "soft tissue" meaning a

sprain or strain and nothing permanent, then in

Louisiana the judges typically look at how long a

person was syptomatic and give them a monthly or

weekly award. This typically ranges from $750.00

to $1500.00 a month plus medical expenses and

other special damages such as lost wages. If the

injury involves broken bones or bulging disks or

other more permanent injuries, the courts look to

what the appellate courts say is the most that

can be awarded for that injury.

You really need to discuss your matter with a

professional who is familiar with your

jurisdiction and the case law for similar injuries.
