Legal Question in Personal Injury in Arkansas
Falsely Insinuation/Accussation
I have been falsely accused of sexual misconduct with my little girl. The accusation was made while I was out of town. I did not hear about it until 4 days after my return. I took her to the emergency room the morning after learning of this and the attending doctor stated that there were no indications of this and that she was a normal, healthy girl. I am a single parent (father) to the little girl who gained custody in the state of California in 1996, 3 months after she was born. This incident took place in the state of Arkansas which now has jurisdiction. I wanted to press charges against the daycare and have spoken with a prosecutor who stated that this would probably be a civil matter. I have nothing against the laws to protect children but, at the same time, innocent people need to be protected against false accusations because of personal indifferences, in which, in this case I believe there is. I am currently working with an attorney but, I am also looking for any and all information I can that could and would help me in the case. What laws are there to protect the innocent against false accusations? What charges can be applied if any? Is there anything else except "Slander"?

For general information regarding your situation, you should research the Wenatchee Sex ring cases from Wenatchee, Washington. I recall that a book was written about these cases which invovled shakey child sex abuse criminal proceedings and convictions which were later overturned. Several civil suits have since been filed.
