Legal Question in Real Estate Law in Arkansas

lawsuit regarding termite damage

Help! I have been in litigation with a termite co. for 18 months. Together with my attorney we have proven the termite co. is at fault without a doubt. My trial date is in 6 days. They made two offers and we have insisted on going to trial. During the pre-trial conference, they let my attorney know that if we stand firm on going to trial and if the verdict is too high in their opinion, they will appeal and they made us a third offer. I understand by appealing this could drag out another year or so. My bottom line was only asking that they buy my house at fair market value and pay my attorney fees. That was not acceptable to them. If we go to court they risk outrage and punitive damages as well. Their offers don't cover my losses nor the risk of trying to sell my house later. My house is only a 1400 sq. ft. ranch style home. I know it costs alot to appeal a case. Why would they appeal and run the risk of paying more later? Or, are they bluffing? Please answer as soon as possible, I'm down to the wire. Thank you very much!
