Legal Question in Real Estate Law in Arkansas
Mineral Rights on property
We received a letter or a threat from Chesapeake (Natural Gas) Inc. giving us 4 choices. 1. lease minerals for so much, royalty for so much over 5 yr term. 2. Same as #1, but cash was lower and royalty higher. 3. Participate and pay your part of drilling cost of $3,300.000.00. 4. Be integrated as non-consenting mineral owner and have to pay a penalty. Can they do this, if we don't consent. We don't want our home and grounds ruined by this process. Don't we have a voice in it?
Thanks for your answer......K. Fry

Re: Mineral Rights on property
It sounds like you are getting strong-armed by the gas company. It doesn't appear likely to me that the gas company can force you to sell your mineral rights.
However, it is difficult to give specific advice because I haven't seen their demand letter. If you would like for me to take a look at it and provide some additional advice (at no charge), contact me by email.
