Legal Question in Real Estate Law in Arkansas

Provisional access road

Someone we know has a deed, or abstract, etc. that references a ''provisional

access road'' relative to property they inherited in Arkansas. We never heard

of such a thing. What is it? Could such access lapse, be taken away, or

otherwise disappear leaving the property owner with landlocked property and

no access? What should be done to protect the access rights?

Re: Provisional access road

I'm not exactly sure what the "provisional access road" refers to. It sounds like an easement, but that is just a guess.

Property cannot be left landlocked with no access for the owners. Easements and leases can lapse, but with no access, an easement by necessity would have to be created.
