warranty deeds and ownership
i purchased a parcel of land in the city limits in 1985 a few days ago i found out the city water company was installing a water meter on the property. when questioned about this we were informed that a few years ago the owners of the adjacent property had the lot surveyed and replated into one lot and recorded with the city. city officials are telling us that they cannot change the documents back to the original way they were layed out because it has been recorded without the other land owner signing a paper saying that he doesn't own the property in question. we were never contacted at the time of the survey and still have our copy of the original warranty deed to the property showing the tract in our name. the question is who is at fault in this case the survey company, other land owner (who suposedly signed a paper saying he owned the property), or the city for recording it without proof of ownership?

You need a local land attorney for this one. The facts will control the answer to your question. If you cannot reach an amicable settlement with the other owner, my bet is you will have to file suit to solve your problem.
