Legal Question in Real Estate Law in Arkansas

Zoning Laws

My neighbor started running a pest control business out of his house. I notified the city and was informed that he could not run such a business from his home and that he was in vioalation of several city ordinances. The city attorney sent him a letter informing him that he could not practice business there any longer as the property was zoned R-1. He has since hired an attorney and has filed to have the property rezoned as commercial. What if anything can I do to stop this? I live in a residential neighborhood with many school age children. I do not particularly want commercial vehicles traveling up and down the our street. There is also the issue of his storing dangerous chemicals on the property. Please let me know if I have any legal recourse in this matter. Thank you for for hearing my question. Don

Re: Zoning Laws

You have a right to try to stop the city from rezoning the area. I don't know what city you are in, but most cities have a city council that decides issues like this. Find out who your city councilmen are and call them, or go to any meeting where this is discussed.

You may have a civil remedy against this neighbor if you have felt any damages from this business. You may want to consult an attorney in your area to go over the possibilities of an action. Call a local attorney. The first consultation for this may be free. Ask that up front, and they should be able to help you find out better what your options are.
