Do I have to have an accident report to win a case in small claims court
I was involved in an accident approx. 4 months ago. It was minor, we exchanged information and went on our way. When I called the party later in the day to check on her getting with her insurance to pay for the damage to my bumper she said I would have to take it up with her husband since he handled all that type stuff. She claimed she had liabilty insurance. Her husband asked me to get some quotes on repairs and get back with him. After doing so he claimed all three estimates were too high. He refused to pay anything or do anything. After several calls and a few letters this problem has still not been corrected. We did not call the police to the accident because it was raining, we were on the side of the road and the damage was minimal by todays standards (average estimate was $1,000. What are my odds of taking them to small claims court and winning for the estimate average and court costs? Any other ideas? Thanks.

You may want to check with the small claims court to see what the maximum amount of recovery is in their court.
Or, you may want to have an attorney send a letter and attempt to help you collect.
Your chance of winning in small claims court depends on a lot of different factors, one of which being whether the other party admits to fault, or whether they try to make you prove it.
