Arkansas Will Laws

Mom died - sister is executor of estate and don't talk to me. Does mom's will have to be honored and how do I get a copy o the will or can I? I don't know the lawyer or if it was in Arkansas or still the one in Nebraska. I know my mom's wishes were for things to be equally split between the 3 daughters but they don't and won't talk to me. She died the 5th of January. What good is a will if they don't have to be honored? Thanks

A will does have to be honored. But if it is not filed with the court, the court won't be aware of the will. If, and when, it is filed with the court, you can get a copy of it from the clerk of courts in the county that it is filed in. You just have to pay for the copy costs. The problem for you may be finding where that is. It is usually where she was last living, or where she has property.

If you are to receive anything from the will, you are supposed to receive notice of the filing with the court. The attorney or executor should send you some notices of the proceedings. They may send a copy of the will. But they have some time before they have to file the will, so it may be awhile before you see it.
