Legal Question in Wills and Trusts in Arkansas

Details of inheritance

Hi, About 3 months a go a dear friend passed away and about a week or 2 later the executor of the will contacted me and said that there was a money issue that would be settled with me but he said he could not say anymore at this time. From that date I have not heard anything from the executor. The estate is very very large ie 10s of millions . I do know most of this was held in trust and the executor of the will is also the trustee. What i would really like to know is the time scale it normally takes to find out the exact inheritance iam due, i knwo there is something just dont know what.My friend hinted that it would be a trust fund, how would this work as i live in the uk and my friend was from the uas. thanks in advance

Re: Details of inheritance

If your friend left a will, you can find out very quickly. If your friend had a trust finding out information will be more difficult.

If there is a will and the executor is appointed, then you can get a copy of the will. If it has not been admitted to probate, you can file a demand for notice and then before the will is admitted you will be notified of the date for the hearing. What county did your friend reside in at the time of death?

If your friend had a living trust, then your access to information depends on whether you are a beneficiary. If you are neither a beneficiary or an heir then there is no obligation to provide you with any information. However you can ask the executor or have someone ask on your behalf and if you are a beneficiary they should tell you. Call me if you want to discuss. 501.312.8600. Good Luck. Wayne Ball

Re: Details of inheritance

If the money is in a trust, it will not be in the probate of the estate, unless the trust ended at their passing, or is being established by the will.

As far as what is in the estate, you, or your attorney, can send a Notice to the courthouse of the county in which the estate is probated to be informed of all actions of the estate.

If it is in a trust, you, or your attorney, are going to need to request a copy of the trust document and determine what the status is.

This is just a general outline of where you need to start. There are more questions that I would have to ask you to be sure of exactly what is going on with this estate. If this is for millions of dollars, you need to obtain an attorney immediately to protect your interests and keep you informed of what is going on.
