Legal Question in Wills and Trusts in Arkansas

My father in law has property, but is in bad health, and has no will. If he prepares a will now to give the land to his daughters, and has to go into a nursing home at a later date,, how many years does the will have to be in efffect before the state can no longer go back and conficate the land for payment?
