Legal Question in Wills and Trusts in Arkansas
Sister pasted away with no will
My brother & I live in Michigan, my sister lived in Arkansas, she unexpectally passed away on June 1, 2008. She had no spouse, no kids. Our parents have passed away, there's myself & my brother left. We are trying to figure out how we go about handling her estate & are having a hard time doing so. We are clueless. Her estate includes a house, the contents of her house, a car & her stimulis check. I have called the probate court in the town that she lived in & they told me to call an attorney, so I called an attorney whom handles estates & she told me to call probate court. Please give me some guidance, we are lost. Also is there a waiting period before we can do anything with her estate?

You need to HIRE a lawyer in Arkansas to look into this. If you can't find one helpful, try contacting the Arkansas State Bar Association, as I do not personally know any estate lawyers in that state. You basically need to have power of attorney and/or letters of authority (depending on the laws in that state), so you can transfer her real property, access her bank accounts, cash any checks that come in, pay off the bills, etc.
There is no waiting period, and I would strongly suggest you act as quickly as possible to avoid late fees or a decline in the value of any property due to lack of maintenance, etc. You should contact a realtor to handle the sale of her house, and perhaps she/he can recommend lawyer that they have worked with in the past.
