Legal Question in Wills and Trusts in Arkansas

Who can look at trusts

My father died recently and he had in place a living trust. His wife (not my mother) is the executor of the will and my brother is next in line in case something happened to her. All three of us are named in the trust relative to some invetments my Dad had (splitting three ways). She (the wife) is saying that she does not have to let us see the trust. I disagree. Who's right? Thanks!

Re: Who can look at trusts

Unfortunately, without good cause for believing she is committing waste or violating her trustee duties, she does not have to show you the terms of the trust.

Of course, depending on how the trust was written your brother may be able to get certain rights to review the trust.

This may be a little more complicated than you realize, I suggest you speak to an attorney and provide whatever information you have at your disposal.

Our office specializes in trusts and estates but I would have to run this situation by my partners to see if we would be able to assist you.

Please feel free to contact me at the email address provided by LawGuru to discuss this matter further off of a public forum.
