Legal Question in Technology Law in Australia

Software Licenses

I am currently studying whether the "licensing agreement" supplied in the box when you buy software has any contractual force due to the fact that the consumer really has no notice of the terms of the license until he/she opens the box at home. I have looked at the decision of ProCD in the US- are there any decisions/statutes in Australia which deal with the issue?

Re: Software Licenses

Most of the law in the area of shrinkwrap licences has arisen in the US.

You may find some useful information in a paper on our website which addresses mass marketing of software.
