Legal Question in Consumer Law in Australia
Yacht offer not accepted but later granted to another offeree
A yacht owner, in a letter to a club said that he will sell his yacht for $80 000 to the first club MEMBER to accept. Letter was read at 7:30pm.
Mr X sent an email accepting the offer at 9:30pm. The yacht owner read the email at 10:00am the next day.
Mr Y posted a letter accepting the offer at 9:00pm and the owner of the yacht received it 2 days later at 3:00pm.
Mr Z, NOT a member rang the yacht owner home offering to pay $90 000 for the yacht. The yacht owner's wife answered the phone saying she had been told to receive any acceptances as he was absent and told Mr Z to call later to arrange delivery.
The yacht owner wants to give the yacht to Mr Z, but Mr X and Mr Y claim the yacht legally belongs to them.
Who does the yacht belong to and what is the law or authority that says this?
