Legal Question in Family Law in Australia
My ex wont let my 13 yr old visit or phone his family
My 13 yr old son has lived at his fathers for nearly 12 mths. We have not seen him in this time. The father has stopped all contact via phone including my sons mobile which I gave him before he left so I could keep in touch, so now his brother & sister cant keep in touch which deeply worries them & me.
The last phone call was on my sons 11th birthday last week. During that time approx 3 weeks with no phone contact at all. We left messages at the grandparents where the father & my son live & no messages were given or passed along so my son new we were trying to ring.
Now the father & grandparents arent claiming any acknowledgment of the other two children as being theres. They are only interested now that they have my oldest son in him. I feel disgusted that this has been said to me and my son that lives with us over the phone. The father & grandparents do not want a thing to do with the other two kids. And they still wont let me talk to my son.
What can I do? I have been wanting my son to come home but I feel that he is only there as a prize to hurt me.

You have the right to make an application to court to ask for an order to allow you to spend time with and communicate with your son. It is important that children maintain contact with both parents and their siblings. I suggest you consult a solicitor who specialises in family law to seek advice and to try to resolve the matter without going to court.
