Legal Question in Family Law in Australia

Australian Family Law agreement

My husband and I have lived separate lives for the past 5 years. We are now discussing the possibility of his moving into my house. We would like to have a legal agreement that we have no claim on each others assets. Is such an agreement possible?

Re: Australian Family Law agreement

It is. You need to preapre a Binding Financial Agreement. It reads like a legal contract or deed. It doesnt have to be filed in the Court. In your case it would annexe a list of your assets, and his assets and declare that yours will always stay yours and his will always stay his. If it is prepared correctly it is binding. You should engage a solicitior to ensure that it is prepared correctly.
