it depends on the circumstances. if both parents agree then you can apply to the state courts for a change by deed poll. if both parents dont agree then you need to apply to the family court for permission for the child to be known by the proposed new name. it is up to the other parent to say why they oppose it. you would need to prove that you had a good reason to change it. in queensland another way is to apply for a change to the entry on the births registry to the state magistrates court. again, you have to have a good reason. it couldnt be something like, its a funny sounding name, or the child was named after the grandparent and i dont like the grandparent, etc.
