Under recent changes to the Family Law Act the court there is a presumption of equal shared parental responsibility. But this doesn't mean in every case there is to be equal time with the children. Whether a court would order "shared custody" would just depend on the circumstances of the case and most importantly whether it is in the best interests of the children.
