Child custody

Can the mother move interstate with the child away from the father against his will? Is there anything you can do to make her stay within a local region? How much would the whole legal process cost?

Since the act was amended mid last year, the onus again rests upon a parent seeking to move away to convince a court that it is in the best interests of a child to be moved away.

Therefore if the other parent has moved or is threatening to move you should seek advice as soon as possible.

It is impossible to say how much these things will cost without looking at all of the facts but you should probably brace yourself for something in the order of about $5000 to prepare for and conduct an interim hearing. They can be more though if the case is complex.
