Child custody

Is it possible to do something through the police to keep the mother and child local so that the mother cannot leave with the child? or does this have to be done in court? How would I go about taking this matter to court? Who do i need to contact and can the police stop the mother from moving away in the meantime? Shes lets the father see the child whenever he wants. there is no problem with visitation but now she wants to move back to VIC (we are in NSW). Could you please outline the steps to be taken in this process and maybe some phone numbers?

Unfortunately the state police wont be able to do much about any attempt by th mother to move away. Only the Family Court or Federal Magistrates Court can make such orders. In most cases the Court will make such an Order for you, certainly on a temporary basis. You should see a solicitor as soon as possible. If you cant see a solicitor, contact the Federal magistrates Court Registry and they will help you identify the forms that you need to complete to get a case started. If you wish to speak to a solicitor, consider contacting the NSW Law Society and asking them for the names of a few solicitors who specialise in family law. If funding is an issue, conside contacting the legal aid commission in NSW.
