Legal Question in Family Law in Australia
Paternity fraud, Child Support re-imbursement
My current partner (we have two kids together) is a victim of paternity fraud, child involved is now 12. He has applied to the court for the child support to be repaid. The mother is asking for all my financial details, she wants me to complete a financial form. Do I need to? She is in a de facto relationship also, but we cant prove they live together, they share a bank account. where do we stand in relation to financial details of both partners of the parties involved in the court proceedings.

Re: Paternity fraud, Child Support re-imbursement
I can't see how your financial position is relevant to the court proceedings. So I don't think you should be reqired to disclose your financial position. But nor do I think her de facto's financial position is relevant so I don't think he should be required to provide his details.
