Re: Residential custody

I refer to your recent enquiry. If your enquiry relates to the law of residential custody in Australia then please be aware that under Australian Family Law there is no such term as custody or access. Each parent of a child has what is known as Parental Responsibility which enables each parent to make all day-to-day and long-term decisions for the care, welfare and development of the child. The Court is able to make Orders as to where the child lives (referred to as Residence Orders) and also the Court can make Orders as to how often the child sees the other parent with whom they do not live with (referred to as Contact Orders). If you wish to obtain more specific information about childrens matters under Australia Family Law then you can visit my website at www.hartleyfamilylaw.com.au and look at some of the Information Sheets that are contained on that website.

Yours faithfully,
