Legal Question in Family Law in Australia

Seperation

I was wondering where i stood in this situation - my husband and I have been seperated for 8 months and he has moved states leaving me with everything. I told him to take what he wants but he told me I could keep the lot. My question is does he have any right to any of the furniture?

Re: Seperation

At this stage he does still have a claim in relation to any assets. If we are only talking about furniture it may be that he either doesnt want any for personal reasons or it is too expensive to do anything about it. Once the two of you have been separated for 12 months, either of you can apply for a divorce. Once you are divorced, if either of you wants to seek a court order relating to any assets or maintenance, you must file the application within 12 months of divorce. Once one of you applies for divorce that might flush out any claims that he may want to make to the furniture.
